in defense attorney and law professor joey jackson. joey, you know, on the surface this sounds big. almost unbelievable. >> huge. >> how could they have missed this, but i guess the question is if it hadn't been missed, if they had found this, if the prosecution had this in their hands, would it have changed the outcome? >> i think this is what we call outcome determinetive. how powerful would it have been for the prosecution to have evidence the day she went missing of a search that said "fool proof suffocation." i think it's a game changer. it's a huge miss on their part. even more importantly, the defense had this. how could the prosecution not? >> that's right. defense attorney jose baez said he knew about this all along and was actually waiting for it to come up. >> it never did. exactly. so interestingly enough, the question is asked, well, you ho could a defense attorney do that? don't we share information? the answer is yes but no, but here's what i mean. there's an obligation for what we call reciprocal discovery. if i have information, i have to give it to the prosecution so they
in sheila jackson lee. so we were just talking about that with susan. would you be comfortable with the fiscal cliff that kept the rates the same but limited their deductions. >> you know, my main focus would be to ensure that the middle class are restored. in order to do that we cannot allow the bush tax cuts to continue. we must focus on saving medicare and social security. tax reform raises many proposals. the question of rates. the question of deductions. and i think it's dangerous to not look back and reflect on what got uz into a positive economy. it created 20 million jobs. higher rates in terms of tax rates for the healthy and created a tax scheme, if you will, a structure that protected the middle class. that's what i'm interested in along with entitlements that are a safety net for the middle class, and we're not prepared to look any way that would undermine those protective nets. in that means rates have to go higher for the wealthy, then i think the wealthy who voted for president obama in large numbers understand the mutual sacrifice necessary to build and continue
. >> all right. rafael martinez, thank you for joining us. i want to bring in joey jackson, defense attorney. joey, it is an interesting case here. he's decided to hide, basically run from police, but these actions could make things much worse for john mcafee than turning himself in, could they not? >> they could, ted. as you know, often times when a person runs, when a person is no longer anywhere to be found it is used later as consciousness of guilt. if you didn't do anything, have nothing to fear, why run, why hide. it certainly could make matters worse. as you know, ted, he is claiming he fears the police based upon his history with them. they raided his home apparently last april, there were some guns taken from him at that time, there was discussion as to whether he was involved in the drug trade apparently or was producing or distributing a.m. fet a means. there's some concern whether or not the police will treat him fairly if he turns himself in. >> are there motivations for murder when you look at the facts of this? >> it's interesting. i don't know whether, and i don't wa
